NAACP Files Clean Air Act Lawsuit Against xAI Over Memphis Data Center Emissions

The NAACP has initiated legal action against xAI and its subsidiary MZX Tech, LLC, alleging violations of the Clean Air Act. The lawsuit, filed in the U.S. District Court for the Northern District of Mississippi, claims the company operated 27 natural gas-burning turbines in Southaven without required air permits between August and December 2025. These turbines provide critical power to the Colossus 1 and Colossus 2 data centers in the Memphis area. The NAACP argues that the emissions of smog-forming pollutants and particulate matter pose significant health risks to the local population, which the filing notes has a higher proportion of Black residents than the national average. xAI has maintained that federal permits were unnecessary as the turbines were for temporary use. However, the company's ambitions in the region are expanding; plans are underway for a more permanent facility, dubbed 'Macrohardrr,' which would utilize 41 natural gas turbines. This legal battle comes at a critical juncture for xAI, which merged with SpaceX earlier this year in a deal valuing the combined entity at $1.25 trillion. The company is currently positioning itself to compete with industry leaders like OpenAI and Google, while simultaneously preparing for a highly anticipated IPO. The environmental lawsuit adds to a growing list of regulatory hurdles for Musk's AI venture, which is already facing scrutiny from EU and UK regulators over the safety and content generation capabilities of its Grok chatbot.
